Vedatrayee Dutta, Junior Research Fellow (JRF), Dept of Law, The University of Burdwan

ABSTRACT

Seven decades after India got its much-priced independence the judicial system has failed to instil confidence in the people. This is reflected in the absence of witness protection in India, despite following the adversarial system of justice administration. The colossal pending cases and the reluctance of the public to approach the courts bears evidence to this fact. It is widely acknowledged that The Indian Criminal Justice System suffers from a number of shortcomings which directly affect the uninterrupted and unhindered deliverance of justice. Witness Protection is one such area in need of robust reformation. Witnesses form an important pillar in any criminal prosecution and are an indispensable part. A major part of the case depends on the testimony of the witnesses. As a result, this particular category of people turns vulnerable due to the sensitivity of the information they are carrying with them. In India many cases are reported against witnesses getting brutally assaulted and getting threats for destruction of life and property. Witness protection is an unexplored area with minimal scholarly attributes. Artificial Intelligence, the field of technology that aims at building programmed machinery that claims to replace human intelligence, has reached every corner of the country and several experiments are being conducted nationwide to use AI for the betterment of different working fields. With the increasing advent of Artificial Intelligence there has been several scholarly attributes towards the usefulness of AI in different fields including law. This paper makes an attempt to study the various methods of AI like predictive analysis and voice cloning securing anonymity with the objective of increased witness protection along with the probable disadvantages of the same.
