ABSTRACT:


India has a vast and complex judicial system for its more than 1.3 billion people. The Indian Litigation and Justice delivery system is time-consuming and cumbersome. The outcomes and decisions of cases are being influenced and affected by the increasing pendency of cases in India. Judicial and legal reforms are essential for India in order to meet the expectations of 21st- century goals. This must be done by maintaining a position that preserves both the court's reputation and also supports the court’s critical role in maintaining public confidence and the protection of the rights of the people. Despite numerous initiatives taken by the government and the judiciary in our country, access to justice remains a challenge for a large section of the population, particularly for the people who belong to marginalized communities. The implementation of the Internet based Information and Communication Technology (ICT) and also the application of Artificial Intelligence (AI) in the Indian judiciary needs transformation and rejuvenation. AI is hailed as a game-changer in a number of fields, and India's justice system is no exception. AI has the potential to overcome some of the challenges faced by the judicial system in India. This research paper aims to explore the Role of AI in access to justice and justice delivery in India, including its potential applications, advantages, and limitations. This paper begins with an introduction that explains the importance of the topic and provides background information on the justice delivery system in India. This paper then focuses on the current state of access to justice in India, including the challenges faced by the justice system, issues related to the number of pending cases, and the impact of the backlog of cases on access to justice. This paper further highlights the advantages and limitations of using AI in the justice system and also proposes some recommendations in order to utilize the Artificial Intelligence (AI) in a responsible way so as to improve access to justice for all.
