The Unscrutinised Ambiguity: Judicial Precedents In Metaverse Cases

Syed Suhaib*, UILS, Chandigarh University, India

ABSTRACT

Metaverse has been mainstream for quite a while as its esoteric nature opened possibilities for potential disputes among its users, or rather "avatars," as they would be called in metaverse. Plethora of authors around the globe have explored and enunciated potential determinations for the potential disputes, but one aspect that has remained unscrutinised is the role of judicial precedents in the cases relating to the metaverse. The judicial system now and then relies on precedents in order to recover the law from ambiguous situations, and postulating the esoteric distinctiveness of the metaverse, ambiguity will incontestably arise. In that situation, will the judicial precedents be applicable in the same manner as they would be in the real world? or will there be certain nuances to it?
