ABSTRACT
This study examines the intergenerational transmission of ancestral property rights, focusing on children's inheritance claims in their mother's familial assets. The research analyzes the legal framework under the Hindu Succession Act and its amendments to understand the recognition and evolution of children's rights to ancestral property, including the rights of adopted children. The findings highlight the significance of lineage and the importance of children's inheritance claims in preserving the familial heritage. The study also explores the challenges faced by children, particularly minors, in managing their inherited property and the role of legal guardianship in such cases. Court rulings and case law are examined to understand the interpretation and application of inheritance laws. The study emphasizes the socio-economic implications of inheritance rights, such as their impact on intergenerational wealth transfer, women's economic empowerment, and financial security for marginalized communities. By tracing the intergenerational transmission of ancestral property rights, this research contributes to a comprehensive understanding of this critical aspect of property law in India.
