ABSTRACT
The emergence of trade unions in the IT sector, once considered improbable due to the industry's unique work culture and high-skilled workforce, marks a significant shift in how employment rights and social security are viewed within this domain. This paper explores the underlying factors that have historically hindered unionization in the IT sector, such as the perception of adequate work conditions, job mobility, and individualized career paths. However, recent developments, including the formation of trade unions in tech hubs like TCS Chennai and the global movement led by Alphabet Workers Union in the US, signal a growing demand for collective bargaining rights among IT professionals.
This study examines the evolving landscape of employment rights in the IT sector, emphasizing workers' challenges, such as job insecurity, wage cuts, and work-life balance issues, particularly during economic disruptions like the COVID-19 pandemic. It also discusses the implications of applying traditional labour laws, to a sector characterized by its fluid and performance-driven nature.
By linking these issues to the broader theme of social security, the paper argues that unionization could play a pivotal role in addressing systemic inequities within the IT industry. While critics argue that unionization might standardize wages and hinder job mobility, this paper contends that well- organized trade unions could help ensure fair treatment, prevent unlawful retrenchment, and advocate for better working conditions, ultimately contributing to a more stable and secure working environment for IT professionals.
In conclusion, the paper posits that forming trade unions in the IT sector represents a crucial step towards safeguarding employment rights and enhancing social security. However, it also warns of the potential challenges and unintended consequences that could arise if the unique dynamics of the IT industry are not carefully considered in the unionization process.
