Uniform Civil Code In India: Exploring The Feasibility And Implications For Achieving Equality

ABSTRACT

This paper primarily deals with Uniform civil code (UCC) in India. Which is mentioned in part VI, article 44 of Indian constitution. It basically means “one country, one rule”, to be applied to all religious communities in India. The paper starts with introduction of UCC and its journey so far and gives a better understanding of UCC and its applicability in India, and why it is still a pipe dream instead of establishing equality. It also discusses the various dimensions of UCC in India. India being a multi-religious country and every religion has its own practices, especially in personal matters, with implementation of UCC in India, it ensures all citizens are treated equally. This paper also discusses UCC in relation to secularism. And reasons why it is important to implement and why its need is most felt in India at least in the modern times. This paper questions why the government has not yet taken any measures in implementation of UCC and the reasons for its failure. Along with that it discusses a few landmark cases in which the judiciary has tried to implement UCC. And lastly this paper ends with conclusions and suggestions.
