ABSTRACT
The doctrine of deviation is deeply rooted in the maritime navigation from olden days. When a ship begins its voyage, it is expected to follow the agreed or usual course of route. If it departs from the agreed or usual route then it is said to be deviated. Deviation impacts the contract of carriage causing delay, loss or damage to the cargo carried in the vessel. In the modern era of navigation, it is possible for a ship to sail without deviation except in cases of rare situations. The law regarding deviation in the contract of carriage also evolved along with the growth of navigation. This article aims to study the about the unjustified deviation in the present legal regulations pertaining to carriage of goods by sea.
