Victims Of False Confessions - An Overview

ABSTRACT


Victims are persons, be it an individual or a group, who have suffered harm, loss, or injury caused by an act or omission which violates the criminal law. Such loss might me physical, psychological, emotional even deprivation of fundamental rights at some times. As this article is all about the victims of false confession. Whenever confession is concerned it is one of the most important elements which plays an important role in the proceedings of the criminal justice system. India is concerned Bharatiya Sakshiya Adhiniyam makes all the confessions inadmissible if they are obtained from a person using force, coercion, threats, etc. This paper tries to explain what really is false confession, how it has been got, causation of the false confession. Further, this paper also includes several case laws and case studies that have happened worldwide due to false confessions leading to wrongful convictions and wrongful prosecutions. This paper concludes with the false confessions happening in India, which led to death, custodial torture, etc.
