Whistleblowing Protection: Comparative Analysis Of India And The United States

Devesh Makholia & Aakash Rana, Amity University

ABSTRACT

Whistleblowing, the act of revealing confidential or unethical activities within organizations, plays a pivotal role in promoting transparency, accountability, and ethical conduct. This research paper presents a comparative analysis of whistleblower protection frameworks in India and the United States. By juxtaposing the legal dimensions of whistleblower protection in these two nations, this study seeks to identify similarities, disparities, and potential areas for improvement. Through a methodological approach that involves comparative legal analysis and case study examinations, the research uncovers key findings. The comparative analysis reveals differences in the legal frameworks, with India enacting the Whistleblower Protection Act in 2014 and the U.S. relying on a combination of federal and state laws to protect whistleblowers.
