ABSTRACT


Surrogacy stands as a crucial recourse for those grappling with infertility hurdles, proffering a beacon of hope and avenues for parenthood through the intervention of surrogate mothers. The legislative amendments ushered in during 2022 aim to bolster ethical standards, safeguard the rights of surrogate mothers, and erect unequivocal legal frameworks encompassing all stakeholders embroiled in surrogacy pacts. These regulations underscore stringent supervision, eligibility prerequisites, proscription of commercial surrogacy, and the primacy of informed consent in assisted reproductive procedures. By adhering to constitutional precepts of equity and human dignity, these mandates signify a momentous stride in fortifying the integrity and fairness of surrogacy modalities. The scholarly exposition delves into the intricate terrain of surrogacy governance, with a keen focus on the Surrogacy Regulation Rules of 2022 in India. It further delves into the historical tapestry of surrogacy in India, the evolutionary trajectory of surrogacy legislation, and the confluence of the Surrogacy Regulation Rules of 2022 with extant statutes and constitutional paradigms. Overall, the study illuminates the profound reverberations of these regulations on ART establishments, surrogacy methodologies, and the welfare of all stakeholders ensnared in surrogacy compacts.
