A Critical Analysis Of POCSO With Reference To Justice Pushpa Ganediwala’s Verdict

ABSTRACT

The Paper starts off with the explanation of POCSO (What the Act is about, why it was introduced and its purpose). After that there is a brief discussion of the POCSO conviction rates and number of cases (Rise in the number of cases). Thereafter the judgement by Justice Ganediwala is spoken about followed by a discussion of Justice Ganediwala’s verdict. Then we discuss the two research questions. Followed by the suggestions and conclusion that is - That POCSO does not require an amendment. Our justice system needs to be amended. What good is an amendment in a law if that particular law won't be enacted/justice won't be delivered by the judges?
