1. INTRODUCTION
In today's world possessing a piece of property is one of everyone's top priorities. One of the most valuable things a person can own is property. Property gives its owner respect, position, and dignity. In addition to tangible and physical property, there is also another type of property that has existed for a long time all over the world. This type of property is known as intellectual property and is intangible, incorporeal, and abstract. The results of this intellectual property include ideas, innovations in various fields or spheres of life, as well as some secret knowledge or know-how that may be related to business, medicine, art, culture, or other fields. Similar to tangible and physical property, intellectual property is protected by several laws and has recently undergone significant development to better serve the needs of the global community.
The current research is being carried out to examine one of the most significant intellectual properties that are trademark, its infringement and passing off action. Although the goods produced by the manufacturer or supplier are comparable to those manufactured by others, they are distinguished by different distinguishing features. Only after the Industrial Revolution, which made it possible for mass manufacturing, distribution of goods, and exposure through various media, was the significance of trademarks realized. In the current commercial market, "trademarks" are particularly significant in this context.
