ABSTRACT
This research article explores the concept of legal aid, with a specific focus on its evolution and implementation in India. Legal aid, which ensures equal access to justice for all citizens, particularly those who are economically disadvantaged, is a fundamental component of the Indian legal system. The paper begins by introducing the concept of legal aid and its significance in promoting social justice. It then traces the history of free legal aid in India, highlighting key developments and initiatives aimed at providing legal assistance to the marginalized and economically weaker sections of society.
The article further examines the constitutional provisions related to legal aid. The role of the judiciary in advancing legal aid through landmark rulings and judicial activism is also discussed, emphasizing the significant contributions of the courts in ensuring the protection of fundamental rights through legal assistance.
Despite the existence of a robust legal aid framework, the paper identifies awareness as a critical challenge that hinders the full realization of legal aid services. Many individuals, especially in rural and underserved areas, remain unaware of their right to free legal aid, limiting their access to justice. The paper concludes by reflecting on the importance of bridging this awareness gap, strengthening legal aid initiatives, and ensuring that the benefits of legal assistance reach every eligible individual.
