Accessing The Role Of Courts In Company Law

ABSTRACT


The courts under company law have been playing a prominent function in the corporate sector of India and have a wide range of powers. This study explores the role of the courts and how they have consolidated and simplified the dispute resolution mechanism in the corporate sector, established under the Companies Act, 2013. This analysis explores through a historical perspective, the history and evolution of the courts under the act. It delves into the Judicial functions of the courts in the company law and the powers of the established courts in the company law matters. Additionally, it also explores the debates and controversies regarding the establishment of these courts in Company law jurisprudence and landmark court decisions in shaping the company law. However, it also dives into the concerns regarding the practical implication of the law for the protection of the interest of shareholders and anticipating the evolving role of courts in company law.
