An Analysis Of Rape As An Offence And The Need For Change In Punishment With The Time

ABSTRACT


Rape Culture refers to a culture in which rape is common and sexual violence against women is normalised and excused in the media and popular culture. Rape culture is perpetuated by using misogynistic language, objectifying women's bodies, and glamorising sexual violence, resulting in a society that disregards women's rights and safety. The Present study, focuses on the Punishment of Rape and analysis has been made that whether the punishments given under Indian Penal Code are sufficient or not. Moreover, referring to Mathura Rape case and a recent incident of 16 December 2012 gang rape in India the researchers have analysed and explained the behaviour of the victim, the protestors and the criminals involved in the crime and its impact on the society. Further, the Justice Verma Committee recommendation that was given after Delhi gang rape case is also analysed. Lastly, an analysis has been made whether the punishments that is given under IPC are sufficient or not?
