An Analysis Of The Inequity In Stalking Legislation

Mr Joshua Joseph Jose & Mr Alvin Sam, B.A. LL.B.(Hons.) The National University of Advanced Legal Studies

ABSTRACT

This paper attempts to elaborate on a niche area of stalking where unfairness is evident due to legislation enacted only for those of the female sex. The short article also compares foreign, social and legislative conditions surrounding the crime of stalking to the Indian situation. The paper seeks to convey that stalking is a crime that can happen to individuals, not of the female sex and can also be perpetrated by them. It then offers remedies to the inequitable position the other sex faces in this country in the issue of stalking.
