An Analysis On The Legality Of The Right To Personal Liberty In India

ABSTRACT


This paper aims to provide a detailed analysis on the topic right to personal liberty. One of the most fundamental principles of human existence is the right to live a free, full, and dignified life. Every individual has the right to live their life on their own terms, free of unjust interference from others. A successful democracy must guarantee its citizens the right to protect their own lives and liberties. According to Article 21 of Indian constitution, 1950 provides that, “no person shall be deprived of his life or personal liberty except according to procedure established by law”. Which means No one shall be deprived of his or her life or personal liberty except in accordance with the legal procedure. As we all know right to personal liberty is a fundamental right under the constitution of India mentioned under article 21.Right to personal liberty includes various rights which is available to any person. Let’s discuss them in detail especially on the legality of right to personal liberty in India.
