An Analysis On Whether Juveniles Be Tried As Adults?

ABSTRACT


Everything is governed by the laws of the universe. Talking about the governance of laws in general there are laws made for the individuals at large. The laws for adults vary from the laws made for children or youngsters. The research paper focuses on the concept of juvenile delinquency along with laying special emphasis on the concept of the Indian Justice System and the role played by the same in the law-making procedure for juveniles. The paper revolves around the origin of the concept of the youthful offender and further focuses not only on the introduction of juvenile laws and acts but also lays special emphasis on the concept covering the differences between the biological and the mental age and further the factors taken into consideration while making the juvenile laws. Looking into the juvenile crime rates there are questions raised upon the set criteria for the juvenile justice system and it’s functioning. The research paper further lays emphasis on the comparative analysis of the Indian Juvenile Justice System along with the other Juvenile Justice Systems, specifically that of the west.

The paper tries to analysis and answer the question about treating juveniles as adults depending upon the nature of the crime committed along with the individual’s mental maturity. The analysis to the same has been conducted through the primary data collected through the medium of a google-form questionnaire.
