An Overview Of Role Of The Courts In Combating Habitual Criminality In India Under CrPC, 1973

ABSTRACT

Judicial process is the way through which a common man may get justice. Judiciary plays a vital role in the administration of justice. Another aspect of judiciary is to function as a protector of the society. The prime function of the court is to impart fair and impartial justice. This strenuous task, the judges have to discharge with utmost care and caution so that public confidence in judicial process is not shattered. Habitual offenders are the persons who have the habit of committing crime and commit crime again and again. Special measures are obviously required to stop these criminals from carrying on their criminal conduct for whole of the life. Under criminal justice system, the measures are available in two ways. One way is to punish the wrongdoer when he has committed any offence under the penal laws and another is to prevent a person from committing any offence. The study is concerned with both of the measures regarding habitual offenders under Criminal Procedure Code,1973. The emphasis of the preventive measure underlying section 110 of the Code is to curb the habit of criminality, which means the recurrence of such undesirable and antisocial practices on the part of a concerned person that may tend to lead him to the career of crime.
