ABSTRACT
This paper examines the evolution and application of copyright law in social media platforms, with a focus on the Indian context. It provides a historical overview of copyright, from the Statute of Anne to contemporary Indian legislation, and explores the adaptation of Indian copyright law to the digital realm, including the 2012 amendment and accession to WIPO internet treaties. The study analyzes the implementation of copyright mechanisms by major social platforms such as YouTube and Instagram, detailing their policies, content ID systems, and DMCA takedown processes. Relevant case law is reviewed, covering the concept of intermediary liability and "dynamic injunctions" in Indian jurisprudence. The paper also considers the ramifications of copyright malpractice, including revenue losses for creators due to widespread infringement. Proposed solutions encompass improved infringement-detection technology, enhanced tools for creators to report violations, stricter law enforcement, and increased collaboration between platforms and stakeholders. The study concludes that addressing pervasive copyright infringement on social media requires proactive methods and balanced cooperation among interested parties to protect intellectual property rights while fostering innovation. This necessitates the continuous evolution of legal frameworks to keep pace with advancing technology and online environments.
