ABSTRACT


This research paper critically evaluates the Insolvency and Bankruptcy Code (IBC) in India, identifying key flaws in its implementation. Specifically, the paper examines challenges related to bureaucracy, claims filing processes, and the interplay between the realization of operational creditors and liquidation value. Drawing on existing literature and expert opinions, the paper provides recommendations to address these flaws and enhance the IBC's functionality.
