Constitutional Validity Of Narco-Analysis Through Right To Health Perspective

ABSTRACT

This research paper majorly deals with the concept of narco-analysis as a means for collecting evidence, its constitutional validity and its adverse side effects on the health of the subject. These psychoanalytical tools are used in the process of investigation to determine the truth by mainly relying on the behavioral aspects of the subject. Narco-analysis has proved itself to be a weapon in administration of justice. However, narco-analysis is at loggerheads with the fundamental rights of the examinee who is subjected to pain and suffering during these tests. Resultantly, these deception detection tests have debatable ethical, medical, scientific and legal implications which must to be considered keeping in mind the Right to Health and principles of natural justice, if they are to become a part of the Indian Criminal Justice System without reasonable doubt.
