Constitutional Validity Of Same-Sex Marriage In India

ABSTRACT

Same sex marriage is a union were two people belonging to same sex marry each other which is seen to be opposite in nature in general perspective. Same sex marriage has not been still legalised in many countries including India as they see same sex marriage as a thing which would destroy the purpose of marriage and destroy the family structure of their countries. Many countries like Britain, Spain, Austria have also legalised same sex marriage through bringing necessary legislations in the parliament. Section 377 of Indian Penal Code talks about the Same sex relationships and says that carnal intercourse against the order of nature is illegal. This paper deals with Same sex marriages and related laws and developments in India and other countries.
