Contractual Variations In Civil Infrastructure: A Techno-Legal Study Of Public Works In India

ABSTRACT


Construction contracts in public infrastructure projects frequently encounter variations arising from changes in quantities, design modifications, and unforeseen site conditions. These variations give rise to contractual issues relating to extra items, substituted works, non-BOQ items, and rate determination. NHAI, CPWD, and State Public Works Departments adopt divergent contractual frameworks governing the valuation of such works.


This paper undertakes a comparative analysis of the contractual mechanisms adopted by NHAI, CPWD, and the Andhra Pradesh/Telangana State PWD framework for dealing with variations and extra items. It categorises non- BOQ works into BOQ-derivable, schedule-derivable, and non-schedule items and examines rate fixation methodologies under each framework, including reliance on the Bill of Quantities, Standard Data Books, Schedule of Rates, market analysis, and daywork systems.


The study analyses judicial pronouncements by the Supreme Court and High Courts that emphasise that arbitral and administrative determinations must remain within contractual boundaries. Courts have held that arbitrators cannot disregard express contractual provisions governing rate fixation and that extra-item claims must be supported by contemporaneous measurement records and procedural compliance.


The paper highlights inconsistencies in terminology, classification, and valuation mechanisms across organisations, leading to ambiguity and contractual disputes. It concludes that harmonising contractual terminology and standardising variation mechanisms across public infrastructure contracts is necessary to enhance legal certainty, minimise disputes, and improve efficiency in contract administration.
