Corporate Criminal Liability And The Environment

ABSTRACT


This paper talks about what is Corporate Criminal Liability and how it developed in India and the world. It analysis how corporate criminal liability is connecting to environmental law. It further analysis the criminal penalties imposed on both individuals and corporates for not complying with the rules and regulations. It deals with the provisions under India Penal Code and Environment Law. It deals with the loopholes in law with respect to enforcement of penalty on corporate. It is suggested that there should be an act exclusively dealing with corporates. It further analysis there has been no implementation of environment criminal liability in any of the gas leak cases taken place in India. It is suggested that there should a law enacted for Polluter Pays Principle and criminal liability exclusively dealing with corporates for causing environmental damage.
