Critical Analysis On Rape As An Offence: A Legal Study With Exclamational Critics

ABSTRACT Rape is a heinous crime falling under the Indian Penal Code. Though we’re in the 21st Century yet, we have to take support the old Archaic laws, which neither are capable of understanding the mindset of the young offenders nor can protect the rights of the people. With the aim of critically analyzing the old and obsolete laws, this research paper is written to understand the need of bringing the laws of the new generation so that the offences can be reduced to minimal. With this purview, this paper not only talks of women or girls but also of men or boys such that justice can be brought to the victim irrespective of their gender. Other than that the exception mentioned under Section 375 of the Indian Penal Code is equally criticized for discriminating between married and unmarried women thereby violating Article 14 of the Constitution of India, 1980.
