ABSTRACT


Decoding Issues, Framing of Charges, and Questions of Law are fundamental components of legal pleadings, indispensable in guiding the trajectory of litigation within the framework of the Code of Criminal Procedure (CPC). Pleadings, constituting the initial step in legal proceedings, lay the groundwork for the case's progression, shaping the narrative and determining the scope of legal arguments. This paper endeavors to dissect these essentials in the context of the CPC, elucidating their significance and exploring the intricacies involved.


Decoding Issues in pleadings involves a meticulous examination of the factual matrix and legal nuances to identify and classify the core contentious points. The CPC mandates a clear delineation of issues to facilitate a focused and efficient adjudication process. Techniques such as issue mapping and issue framing aid legal practitioners in this endeavor, ensuring that the crux of the dispute is adequately addressed.


Framing of Charges assumes paramount importance in criminal proceedings, as it delineates the allegations against the accused and forms the basis for the trial. The CPC prescribes stringent guidelines for charge framing, emphasizing the need for specificity and clarity to safeguard the accused's rights and ensure a fair trial. Prosecutors and defense attorneys play pivotal roles in this process, advocating for their respective positions while adhering to procedural safeguards.
