Digital Consent Of Women In India: A Socio- Legal Study Of Cultural Barriers And Online Vulnerabilities

ABSTRACT


This paper examines the concept of digital consent for women in India and its socio-legal dimensions. This paper provides insights about how deep- rooted cultural and social norms including patriarchy suppress women’s digital autonomy.This paper also sheds light on how the legal framework of India is weak in enforcement and vague despite being governed by provisions under IT Act, IPC/BNS and Constitutional law. Drawing on various Judicial Interpretations and Doctrinal studies, it shows that digital consent is not only a matter of law but of empowerment and dignity. The paper ends by giving some recommendations about some social and legal reforms like separate legislation, grievance redressal body and a separate statutory body and more. It argues that safeguarding women’s digital consent is essential for ensuring their broader constitutional rights to equality, privacy, and freedom of expression.
