Fashion Law: Piracy, IPR And Other Legal Aspects

ABSTRACT

Fashion Law, A ‘Not so discussed’ topic but a very important ingredient of the fashion industry. Fashion can be copied and counterfeited products can be manufactured very easily. Even the slightest change in such products can save them from facing lawsuits under IPR infringement. Not only designers and big brands, but every other person talks about fashion. Trends and reels have become a major chunk for fashion creators. Selling Dupes at a lower price has become one of the areas in which various small businesses are blooming. Selling such products by copying the brands is now one of the widely followed practice over the internet. Fashion Piracy and the Intellectual Property laws are known to a few and this has led this industry to be vulnerable to such issues and cases. This paper deals with the importance of IPR laws in reference to the fashion industry by focusing on the issues and various landmark cases in the field of fashion law with a special emphasis on fashion piracy in both National and international aspects. The findings of this research paper have highlighted the need of spreading knowledge among the people about fashion laws and IPR infringement. this will reduce the piracy issues and the citizens will be aware of their rights and duties towards the industry and the law. Cases from the past years and landmark judgements from both India and foreign Countries have been made a part of this paper.
