Freedom Of Speech Vs. Hate Speech: Where Should The Line Be Drawn?

ABSTRACT


This study put emphasizes on the difference between free speech and hate speech. The basic difference is that freedom of speech has been mentioned in constitution of India and various other conventions Worldwide and there are various legal pronouncements that highlights and limits the scope of free speech which also includes hate speech which incites hate, violence etc. against a person or group of individual. Free speech a cornerstone of democratic societies enables individuals to express themselves. The rise of hate speech has challenged the boundaries of this fundamental right and raising critical questions about the balance between protecting expression and preventing harm.
