Gender Discrimination With Reference To Capital Punishment In India

ABSTRACT

Beginning with a recap of the discussions about gender bias and inequity in the death penalty system, this article continues the analysis of the disparity found in the justice system when it comes to Capital punishment in the nation by discussing some popular case studies. It appears that female offenders have historically received different treatment from male offenders under the death penalty system, sometimes for justifiable reasons but far too frequently due to sex bias. The following section of this article examines aggravating and mitigating factors under death penalty laws, identifying women who have received death sentences, had those judgments overturned, had their death penalties carried out, and those who are still waiting to be executed.
