ABSTRACT
India has a rich and diverse cultural heritage, so it should come as nothing unusual that an immense variety of people from various backgrounds, religions, and ethnicities call it home. India is family to Hindus, Muslims, Christians, Sikhism, Buddhism, Jainism, Parsis and many additional faiths, making it one of the most religiously diverse nations in the world. The paper looks at the delicate socio-legal issues related to India's Uniform Civil Code (UCC) implementation. The paper begins by examining the constitutional underpinnings of Uniform Civil Code in light of Directive Principles of State Policy Article 44, which has not been widely applied since India gained its independence. In India's pluralistic society, the study examines the conflict between religious personal laws and constitutional uniformity through a critical socio-legal lens. The researcher humbly attempts to find out the challenges in the implementation of Uniform Civil Code in India. The paper assesses legal pluralism against constitutional goals by using comparative analyses of recent state-level developments and the seminal Shah Bano case. According to the findings, a balanced strategy that balances respect for India's various religious traditions with basic constitutional principles is necessary for the successful implementation of the Uniform Civil Code.
