Indianisation Of Indian Judicial System: A Viewpoint

While endorsing the observations made by Justice S. Ratnavel Pandian1 wherein we are provided with the seven questions, notwithstanding, only two appears relevant to me as of now:


1. Whether the present day ‘Solomon’s throne (symbolising the majesty of our justice system) is fully supported by the ‘Lions’ (symbolising the legislature and executive) where the latter are still under the throne ?


2. Whether the ‘Solomon’ has any right of proposing any celebrated structural reform of his ‘house’ (symbolising the judicial structure) or is it for the ‘Lions’ to make such proposal to ‘Solomon’s house’ without reference to Solomon?


Simply because the Indian judicial system being pyramidic in character is vertically structured with the Supreme Court at the apex with the intervening layers consisting of subordinate judiciary at the grassroots level, district judge at the middle level and the Hon’ble high courts at the state level, and while I was grappling with my thoughts as to how do we effectively enhance the efficacy of the existing structure, the question which I was introduced to and actually triggered my conscience is: Whether with the existing judicial system are we actually achieving the true scope of justice vis-à-vis the people of Bharat while protecting and preserving their indigenous and incredible civilisation2? Therefore, this work intends to critically evaluate the core problems such as of language, technicality, extensiveness and the complications etc. embedded in the existing Indian Judicial System eventually, undermining the whole system.
