Baishali Bhattacharjee, Department of Law, Assam University Silchar

ABSTRACT

In the realm of vaccines, a variety of intellectual properties comes into play starting from it’s manufacturing to production and distribution. Vaccines maybe granted one or more IP rights including Patents, Trademarks, and Trade Secrets. Therefore, the discussion should not solely revolve around the application of a single Intellectual Property (IP) to vaccines. This article attempts to discuss various IP rights and their relation to the production of vaccines. Since development in the area of vaccines is humongous, there are various challenges faced by both developed and developing countries when it comes to the distribution and accessibility of vaccines to the lower-income strata of the population. This article also aims to create a picture of how the application of Intellectual property rights in the current situation can severely affect the production of COVID-19 Vaccines.
