Law For The Protection Of Advocates: A Need Of The Time

ABSTRACT

Advocates playing role in upholding the rule of law and ensuring justice, have become the target of violence, harassment and intimidation today. Advocates play a vital role in administration of justice, protection of human rights, democracy and rule of law. Nonetheless, it is clear that attacks on advocates both individually and institutionally are continuing, jeopardizing their ability to practice law freely and safely. Freedom of the legal profession is essential to maintain respect for fundamental freedoms and human rights. Neither the rule of law can be upheld nor justice can be properly administered if the advocate is unable to act independently, impartially, objectively and with integrity, autonomy and neutrality. Attack on advocates in Jabalpur (Madhya Pradesh), Mumbai's etc. are some such examples which show how safe are the advocates in India. These crimes reflect the careless and lax attitude on the part of the police department and administration. In protest against such incidents, advocates of many courts across the country are calling for strike and indefinite boycott of judicial work. They are also demanding a law to protect advocates and their families, but their plea has so far gone unheeded.
