ABSTRACT
This paper explores the rights and challenges faced by transgender children in India, emphasizing gaps in legal protections, societal inclusion, and access to essential services. Despite the introduction of the Transgender Persons (Protection of Rights) Act, 2019, which aims to secure legal recognition and prohibit discrimination, implementation challenges and policy shortcomings persist. Transgender youth continue to face discrimination within their families, schools, and broader society, which often results in mental health challenges, limited access to healthcare, and barriers to educational and employment opportunities.
A key focus is the uneven enforcement of the Act across states, leading to regional disparities in the support available to transgender individuals. Progressive states like Tamil Nadu and Kerala have pioneered inclusive programs, while others lack similar initiatives, underscoring the need for a cohesive national policy framework. This study highlights the importance of comprehensive legal reforms, including enhanced anti-bullying laws, self- identification rights, and affirmative action, to ensure equal access to education, healthcare, and employment. Addressing these gaps is essential to creating a supportive environment for transgender youth, fostering a society where they can thrive with dignity and equality.
