Marital Rape: A Relook Through An Evolving Lens In The Ambit Of Section 375 Of IPC, 1860

ABSTRACT

The current need of criminalizing marital rape in the Indian society has been seen. The effectiveness of country’s law, justice, dignity, and integrity of the woman are the major concerns. If it is criminalized in India how it will affect the married life of the spouse is also considered. Some claim that if it is criminalized it will tear up the married life of people and how will it be proved in a marriage sphere seems as a major concern. Indian law is enriched with the principles of law i.e., justice, equality, and liberty. Indian courts follow the principle that thousands of culprits can escape, but one innocent should not be punished.
