Medical Termination Of Pregnancy In The Light Of Human Rights

ABSTRACT

The concept of abortions has been subjected to much debates and discussions because of the contemporary delivered in issued in countries like as the United States and India. These laws and judgments have a tendency to hinder the exercise of fundamental human right to medical aid and safe abortion and interfere with women’s reproductive choices. People hold varied opinions w.r.t to women’s right to terminate pregnancy and an unborn right to live. Therefore, the very purpose of this paper is to analyze the present scenario regarding abortion laws in India and how they tend to infringe the human rights. Focus has also been on the aspect right to live of an unborn child. In addition to this, judicial decisions on abortion laws and constitutional obligations would be looked into. At last, the paper would also focus on interplay between human rights and right to abortion.
