Online Advertising Frauds And Its Legal Framework

ABSTRACT

Rapid changes in the internet lead to the development of new businesses and changed the methods of doing business. The traditional system of marketing and advertising is replaced by online advertising which in turn boosts the marketers to reach their target audience easily without much cost and effort and with high impact. Online advertising fraud has turned into a major concern for law enforcement in many parts of the world. All frauds and crimes committed in the virtual platform are not properly identified or reported, and thus may not appear in the records. At present, there are no specific legislations or statutory bodies in India to deal with online advertisements and thus the laws and bodies that govern offline advertisements are entrusted with the authority to regulate online ads. In this paper, the researcher adopting doctrinal approach aims to highlight the concept of online advertising, online ad frauds, current laws dealing with it, suggestions for specific legislation, and outline the challenges that have occurred over time.
