Outsourcing Of Services Under Labour Laws In India: Legal Framework, Sectoral Analysis And Contemporary Challenges

ABSTRACT


This research investigates the vibrant environment of service Outsourcing in the context of Indian Labour law, assessing legal limits, Industry specific trends, and compliance issues in different sectors, Including IT, Manufacturing, Corporate services and government functions. Using up-to- date experimental evidence, Supreme Court judgments, and recent legislative developments, the work considers major sectoral variations in outsourcing practices and protections for workers. It engages the contract labour (Regulation and abolition) Act,1970, The industrial dispute act ,1947 and the labour codes (2019-2020), in addition to major judicial precedents like steel authority of India Ltd. v. National Union waterfront workers and recent determinations of employment status. The study identifies that although India handles more than 55% of worldwide business process Outsourcing, which estimated IT-BPO Revenues of USD 350 billion by 2025, Collective utilisation of contract labour in manufacturing Where it generates more than 40% of the erstwhile workforce, it is a large enforcement issue.
