Parmeet Singh, Christ (Deemed to be) University, Delhi, NCR

ABSTRACT

The right to privacy is defined as the right to be left alone. A citizen has the right to protect their privacy and the privacy of their family, marriage, reproduction, maternity, child-bearing, and education - Privacy encompasses not only that but also data, communication, consent, dissent, and cognition. As a result, its preservation is critical for human dignity and survival. Anyone who publishes anything on the following topics without the person's consent could face a lawsuit for damages. This paper talks about Pegasus's famous spyware through which Phones can be tapped, encrypted audio streams can be listened to, and encrypted texts can be read using this sophisticated surveillance tool developed by Israel's NSO group. Its goals in India and overseas, the harm it causes to citizens, the country's existing surveillance laws, and the Court's response to the problem.
