Polluter-Pay’s Principle: Challenges To Its Implementation In India

ABSTRACT

Indian environmental law has come a long way in the past decade, by implementing effective international principles to address growing concerns. In such an effort, it has also significantly adopted the Principle of Polluter Pay’s within its environmental jurisprudence. However, there appears to be a significant gap between what the Polluter Pays Principle asserts and what has really been achieved, especially in the Indian context. This paper analyses the same by navigating various Indian case laws.
