Varsha Singh, LLM, National Law School of India University, Bengaluru.

ABSTRACT

Many philosophers of eminence have highlighted the relationship between property and freedom. Private Property ensures better resource management, creates an ecosystem of incentives and rewards, leads to wealth maximization and can also perpetuate individual liberties. This article focuses on one of such reasonable justifications for private property, i.e. liberty. This analysis has been done while using the example of Indian Schooling Sector. Through this article, I have highlighted how the right to private property creates private autonomous spheres, allows exchange of ideas without the fear of retribution, expands the choices of the consumers and strengthens a free society in a multitude of different ways. This article lays down a novel approach in addressing private property and free societies in India.
