Dr. Chandralekha V, Assistant Professor, SDM Law College, Mangalore, Karnataka

ABSTRACT

Persons who are forced to leave their dwelling place and are found within the boundary of state are called internally displaced persons. Basic human rights of those people are in danger. It is the duty of state to protect them and supply the basic amenities of life in the name of rehabilitation. But unfortunately, such protection has been lacked on the part of government. There is no specific law to protect such IDPs. Recently government of India passed Land Acquisition and Rehabilitation and Resettlement Act, in which government or private individual whoever it, can acquire private property for public purpose activities and suitable measures should take to resettle those people. This law is applicable for development induced displaced persons. What about the persons displaced because of Naxalites activities, natural calamities etc? Such IDP’s are at high risk of subject to exploitation and vulnerabilities. They are subject to various Crimes especially sexual assault, physical assault etc. They are deprived of adequate food, shelter, health and education services. The tribal population displaced from Western Ghats region under development activities, are also struggle to adjust in rehabilitated area.
