Revolutionizing Criminal Investigations: The Forensic Mandate Under Section 176 Of BNSS

ABSTRACT


The enactment of Section 176 under the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 marks a transformative development in India’s criminal justice system by mandating forensic investigation in serious criminal offences punishable with imprisonment of seven years or more. This article explores the legal, procedural, and systemic implications of this provision, highlighting its potential to enhance evidentiary integrity, reduce investigative arbitrariness, and increase conviction rates. Drawing parallels with international forensic standards, it underscores the alignment of Indian law with global best practices in scientific policing. Despite its promise, the article also identifies key implementation challenges such as infrastructure gaps, shortage of trained forensic personnel, and inadequate procedural training among law enforcement. It concludes with strategic recommendations for capacity building, oversight mechanisms, and technological integration to ensure that Section 176 evolves into a robust pillar of a science-led, transparent, and accountable justice system in India.
