Right To Challenge Alienation Is Not Open To Non-Coparceners

INTRODUCTION


India is been a country which roots are predominantly patriarchal i.e., male dominant. The main reason for the patriarchal grounds of India is “private property”. In Hindu law, a male child also performs certain duties for father, these duties are considered sacramental. Due to this, every parent in society wants a male child who can perform the duties and inherit their private property and follow the succession as the female child will marry and go to another family. This is the main reason our society became patriarchal. Our laws made regarding the succession of property and the transfer of ancestral property is given to male under Hindu succession act, 1956 which states that the male child has the right to carry the ancestral property. This has been a debated topic since then.
