Rights Of Inheritance In A Live-In-Relationship: A Need To Examine The Indian Legal Framework

ABSTRACT


The current legal status of live-in relationships in India is not explicitly defined, as there are no laws or provisions specifically addressing this concept. However, the judiciary has developed jurisprudence through a series of judgments that recognize the rights of couples in long-term cohabitation.

The Supreme Court has acknowledged that such relationships can be considered equivalent to a valid marriage, particularly in cases where the couple has been living together for a significant period.

This development in the legal landscape reflects a growing acceptance of live- in relationships in Indian society, as traditional notions of marriage and family structures evolve. The research aims to analyze recent court decisions related to live-in relationships, compare them with other legal systems, and explore the need for a legal framework to secure succession rights for live-in partners in intestate succession cases.
