Social Security Disparities Among University Academic Employees In India: A Legal And Policy Analysis

ABSTRACT
University academic employees in India, including faculty and nonteaching staff, face significant disparities in access to social security schemes, with some covered by benefits like pensions and health insurance while others are excluded, highlighting systemic inequities. These disparities stem from fragmented labour laws, inconsistent university policies, and the increasing casualization of academic labour. This article examines the legal framework governing social security in India, focusing on the Code on Social Security, 2020, and its applicability to university employees. It analyzes the causes of inequities, including employment status, institutional type, and socioeconomic factors, and draws comparisons with global models like the United States and Germany. The article proposes legislative, institutional, and judicial reforms to ensure universal social security coverage, aligning with India’s constitutional ethos and international labour standards.
