The Competition Act, 2002: A Comprehensive Analysis

ABSTRACT


The Competition Act, 2002, was enacted to promote fair competition, protect consumer interests, and prevent anti-competitive practices in India. Replacing the Monopolies and Restrictive Trade Practices Act, 1969 (MRTP Act), the Act addressed the growing complexities of a liberalized economy. This paper explores the Act's origins, emphasizing the pivotal role of the Raghavan Committee, its objectives, provisions, and enforcement mechanisms. It provides a comprehensive analysis of notable cases that shaped Indian competition law, including Google India, DLF Limited, and the Automobile Manufacturers case. It concludes with a discussion on the challenges and future directions for competition regulation in India.
