The Constitutional Right To Asylum: The Wave Of The Future In International Refugee Law

ABSTRACT


Incorporating both humanitarian along with political aspects, the constitutional right to asylum marks a fundamental evolution in the field of international refugee law. It highlights how constitutional asylum laws differ from conventional international protections by examining their evolution and effects. The Constitutions frequently expand the particular safeguards granted by international law such as the Refugee Convention as well as its Protocol that include protections against discrimination based on race, religion, caste, sex, place of birth and other grounds. The Constitutional laws are dualistic in nature, combining political strategy with humanitarian aim to expand and also limit refugee rights. Therefore, the right to asylum as a constitutional right might mark a radical change in international refugee law and influence future international practices and policies.
